Booking Conditions

1. Introduction

1.1 The following Booking Conditions, together with the General Information contained on our website, www.kerryaquaterra.ie, brochures / leaflets and social media channels, form the basis of your contract with Kerry Aqua Terra Ltd., (referred to as AquaTerra Boat Tours) with postal business address at Jane Street, Knightstown, Valentia Island, Co. Kerry, Ireland (“Kerry Aqua Terra Ltd.”).

1.2 Please read these Booking Conditions carefully as they set out our respective rights and obligations. By asking us to confirm your booking, we will assume that you have had the opportunity to read and therefore have read these Booking Conditions and, consequently, that you agree fully to the Booking Conditions.

1.3 Except where otherwise stated, these Booking Conditions only apply to Tour / Trip / Private Charter / Private Group Adventure or Water Taxi / Ferry, Picnic or Beverages Picnic arrangements which you book with us or through an approved agent, whereby you receive an official Kerry Aqua Terra Ltd. booking confirmation.

All references in these Booking Conditions to “Booking”, “Contract”, “Package”, “Tour / Trip / Private Charter / Private Group Adventure, Water Taxi / Ferry, Picnic or Beverages Picnic”, or “Arrangements” mean such tour arrangements unless otherwise stated, herein referred to as “KAT Tour Arrangements”.

1.4 In these Booking Conditions, “you” and “your” refers to all persons (“Clients or Preferred Partners”) named on the booking (including anyone who is added or substituted at a later date) or any of them, as the context requires. “We”, “us”, “the Company” and “our” refers to Kerry Aqua Terra Ltd. (referred to as AquaTerra Boat Tours).

1.5 By purchasing, attending or following any of our AquaTerra Boat Tour Arrangements bookings, you hereby consent to having read, understood and agreed to follow these Booking Conditions and our terms and conditions of business, in particular maintaining good behaviour towards your fellow guests, AquaTerra tour guides / crew and any members of the public or those sharing amenity sites with our AquaTerra Tour Arrangements.

2. Booking Conditions

2.1 Due to the complex planning, logistics, and ticket issuing that goes into AquaTerra Tour Arrangements, Kerry Aqua Terra Ltd. cannot guarantee any AquaTerra Tour Arrangements booking without payment in full, or, if your booking meets certain criteria, we may offer you the option to pay a deposit. Bookings will not be held or accepted unless payment has been completed.

  • 2.1.1 If you choose to pay a deposit, the remaining balance must be paid in full within the timeframes specified or agreed at the time of booking and in your booking confirmation e-mail.
  • 2.1.2 If we do not receive this balance in full and/or on time, we reserve the right to treat your booking as being cancelled by you in which case the cancellation conditions as set out in the cancellation policy stand.
    • 2.1.2.1 We reserve the right to refuse any order you place with us.
  • 2.1.3 The first named person on the booking (“Party Leader”) must be authorised to make the booking based on these Booking Conditions by all persons/passengers (PAX) named on the booking and by their parent or guardian for all members who are under 18 when the booking is made. By making a booking, the Party Leader confirms that her / hers, he / him / his, and they / them / theirs / it, is so authorised and that all PAX agree to be bound by these Booking Conditions. Standard grammatical pronouns are used in this agreement to maintain clarity and consistency in our contractual terms.
  • 2.1.4 The Party Leader is responsible for making all payments due to AquaTerra Boat Tours. The Party Leader must be 18 years of age or older when the booking is made. Should the Party Leader be under the age of 18, her / hers, he / him / his, and they / them / theirs / it, must have the permission of or be accompanied by a responsible adult/guardian when booking and taking part in the chosen AquaTerra Tour Arrangements.
  • 2.1.5 The Party Leader is responsible for ensuring that all contact information is correct as we may need to contact you regarding the chosen AquaTerra Tour.
  • Contact information includes:-
    • Correct email,
    • Correct phone number, including area code or geographical region code.
  • 2.1.6 We regret that we cannot accept any liability if we, the company, could not contact or get in touch with the Party Leader regarding cancelled or rescheduled AquaTerra Tour Arrangements due to incorrect or wrongly entered information when the booking was completed and processed.
  • 2.1.7 Subject to the availability of your chosen AquaTerra Tour Arrangements, we will confirm your tour by issuing a confirmation invoice.
  • 2.1.8 Payment by credit card or debit card is required to make a reservation.
  • Payment will be listed as Kerry Aqua Terra Ltd. on your credit / debit card statement.
  • 2.1.9 The confirmation invoice will be sent to the Party Leader via email or to an agent acting on their / your behalf i.e., hotel concierge, accommodation provider reception email address, or another agreed contact person.
  • 2.1.10 Please review this document carefully when you receive it as it includes the selected pick-up point / location with Eircode and instructions on how to correctly prepare / dress for the chosen KAT Tour Arrangements.
  • 2.1.11 Contact us immediately if any information on the confirmation, acknowledgement or any other document appears to be incorrect or incomplete, as it may not be possible to make changes at a later time/date.
  • 2.1.12 We regret that we cannot accept any liability if we are not notified of any inaccuracies in any confirmation or document after 24 hours of you receiving it. We will do our best to rectify any mistake notified to us outside the 24-hour time limit, but you are obligated to meet any costs involved in doing so.
  • 2.1.13 The booking conditions apply equally to you and to all persons / PAX named / part of in the / you’re booking. When making a booking on behalf of other people, it is your responsibility as their agent to bring these booking conditions to their attention and ensure that they have read them fully. Please ensure their direct contact number is made available when booking.
  • 2.1.14 Your AquaTerra Tour Arrangements confirmation is an important document serving as confirmation of payment. You must take this confirmation with you for the services you have booked through us.
    • 2.1.14.1 We are committed to sustainability and have transitioned to a paperless system. Please ensure you have your booking confirmation available on your phone for check-in.
  • 2.1.15 Without the confirmation details, you cannot prove that you have booked and paid for the relevant/correct AquaTerra Tour Arrangements. AquaTerra Tour arrangements will not be provided without valid confirmation details. Failure to present confirmation may result in additional charges, payable directly to a crew member.
  • 2.1.16 If you have special requests or require the ramps for wheelchair assistance, these requests must be made at the time of booking or 48 hours before your departure time. Please note – that while we do our best to fulfil special requests, these cannot always be guaranteed.
  • Special requests may be subject to additional charges, which are payable locally at / on the boat. We would advise you to call us directly to discuss what can best be achieved.
  • 2.1.17 Please note that tickets purchased from someone other than an authorised travel agent / hotel / third party website / tourist information provider will not be valid on board or during our KAT Tour Arrangements.

2.2 Cruise Ship bookings and Preferred Partner bookings require a 50% deposit to reserve the booking.

  • 2.2.1 When the deposit has been received, the remaining balance must be paid in full within the timeframes specified or agreed at the time of booking and in your booking confirmation e-mail.

3. Pricing

3.1 Prices are quoted in the local currency of Euros (€).

3.2 Due to demand, unless you have paid in full or paid a deposit towards the AquaTerra Tour Arrangements, or if you obtain a quote from us for a booking, but do not issue payment at the time, we reserve the right to increase or decrease the price at any time before you book.

3.3 The following are not included in the price: –

  • Travel Insurance;
  • Air, sea, rail, or road transport or accommodation;
  • Meals (unless otherwise specified).

3.4 Definitions of a “Child” may vary by reference to age and will determine the price.

  • 3.4.1 Kerry Aqua Terra Ltd.’s definition of a Child in terms of age is standard: an “Infant” is under 2, and a “Child” is between 2 and 10 years.
  • 3.4.2 A Child must take a seat on the boat. An Infant is also provided with a seat onboard any AquaTerra Boat Tour Arrangements.
  • 3.4.3 Please note that our tours do not accommodate infants under 2 years old.

3.5 Whilst we endeavour to ensure that the correct prices are displayed on our website, social media channels, brochures, leaflets, posters and/or advised to you by phone; all AquaTerra Tour Arrangements prices are subject to change and may increase or decrease yearly depending on inflation or the cost of running Kerry Aqua Terra Ltd.

  • 3.5.1 If there is an obvious error with the price of your booking (including where we have confirmed that booking), we will promptly notify you of that error, and where possible, you will be given the choice to retain the booking and pay the correct price within the time period indicated.
  • 3.5.2 Alternatively, you can cancel the booking and receive a refund of any monies paid or select alternative AquaTerra Tour Arrangements, paying or receiving any difference in price to that originally paid. If you do not elect to retain the booking within the time period indicated, we reserve the right to cancel the booking and will refund you any monies paid. Please be advised the cancellation policy differs for a Picnic or Beverages Picnic booking.

4. Amendments & Cancellations by You

4.1 In order to provide the highest level of service and guarantee our tour departures, cancellations or amendments by you may be subject to fees. The policy below applies to all AquaTerra Tour Arrangements options listed and booked through our website, www.kerryaquaterra.ie, or a customer service agent via telephone or email.

4.2 Cancellations received more than 48 hours prior to the Tour / Trip / Private Charter / Private Group Adventure / Water Taxi or Ferry commencement are fully refundable. Cancellations received within 48 hours of tour commencement are nonrefundable.

  • 4.2.1 Please note that the cancellation policy is different for Cruise Ship Group bookings and Preferred Partner tour / group bookings. (See point 4.9 & 4.10).

4.3 For Picnic or Beverages Picnic bookings, the cancellation policy differs due to the outsourcing of food and beverages.

  • 4.3.1 Cancellations received more than 96 hours (4 days) prior to the Picnic or Beverages Picnic Tour / Trip / Private Charter or Private Group Adventure commencement are fully refundable. Cancellations received within 96 hours of food/beverages tour commencement are nonrefundable.

4.4 All cancellations must be completed via phone call, email or through the booking agent / platform. We cannot accept any cancellations via text message, Facebook / Facebook Messenger, Instagram, TikTok, Pinterest, Twitter/X or LinkedIn.

  • 4.4.1 Amendment requests are subject to availability, and price changes and corresponding charges may apply.

4.5 To amend your existing itinerary, please contact us via phone at +353 (0) 87 922 0544 or email info@kerryaquaterra.ie or amend online via the original booking platform.

4.6 If you wish to book extra services not included in your original booking (additional people or additional stops), you can contact us directly via phone or email. This request is subject to availability and may be subject to an increased charge or fees.

4.7 If an individual wishes to cancel a booking, but not the entire party, this will be completed for cancellations received more than 48 hours prior to the Tour / Trip / Private Charter / Private Group Adventure, Water Taxi / Ferry commencement and are fully refundable. 4.8 If an individual wishes to cancel the booking completely, cancellations received more than 48 hours prior to Tour / Trip / Private Charter / Private Group Adventure, Water Taxi or Ferry commencement are fully refundable. Cancellations received within 48 hours of tour commencement are nonrefundable.

4.9 Cruise Ship bookings - should the Tour / Trip / Walking Tour / Island Drive / Private Charter / Private Group Adventure, Water Taxi / Ferry or Tender be cancelled due to the onshore weather conditions; the above policy notes will apply;

  • 4.9.1 If the cruise ship is unable to enter the harbour to disembark guests to take part in a tour, the company will refund 50% of the entire tour(s) cost.
  • 4.9.2 Cancellations 2 months or less before the date of visit cannot be refunded due to the extensive planning and arrangements required to host such visits.

4.10 Preferred Partner Bookings - Should the Preferred Partner Bookings for a Tour / Trip / Walking Tour / Island Drive / Private Charter / Private Group Adventure, Water Taxi or Ferry be cancelled due to other arrangements, reduced numbers or illness; the above and below policies apply.

4.11 For Picnic or Beverages Picnic bookings, the cancellation policy differs due to the outsourcing of food and beverages.

  • 4.11.1 Cancellations received more than 96 hours prior to the Picnic or Beverages Picnic Tour / Trip / Private Charter or Private Group Adventure commencement are fully refundable. Cancellations received within 96 hours of food/beverages tour commencement are nonrefundable.
  • 4.11.2 If adding additional individuals to a Picnic or Beverages Picnic booking, we require 72 hours notice prior to the Picnic or Beverages Picnic Tour / Trip / Private Charter or Private Group Adventure commencement.

5. Late Arrival and No Shows

5.1 Late arrivals and no-shows are nonrefundable.

This is applicable to any individual or party that fails to arrive or arrives after tour departure.

6. Changes or Cancellations by Kerry Aqua Terra Ltd.

6.1 AquaTerra is a boat tour provider / operator and for all AquaTerra Tour Arrangements, it must be understood by the client / guest / PAX or third-party partaking with us, that we, as the boat tour provider / operator, are totally weather-dependent and will only operate when it is safe to do so.

6.2 Our AquaTerra Boat Tour Arrangements options are always subject to suitable weather and safe sea / landing conditions.

6.3 We, Kerry Aqua Terra Ltd. (referred to as AquaTerra Boat Tours), at our discretion, reserve the right to cancel or reschedule at any time or at short notice up and to the time of departure due to a change in weather, safety or unforeseen circumstances that is out of our control, because our crew members and guest / PAX safety is of the utmost importance to us.

6.4 If we do make changes, we will inform the person who made the booking, the Party Leader as soon as we reasonably can.

  • 6.4.1 When booking, it is your responsibility to ensure the correct contact information has been entered in the event that we need to contact you.

6.5 We regret that we cannot accept any liability or be held responsible if we, AquaTerra Tours, could not contact or get in touch with the Party Leader regarding cancelled or rescheduled AquaTerra Tour Arrangements due to missing region / country phone number code, incorrect or wrongly entered information when the booking was completed.

6.6 We reserve the right to make changes that are not significant and to correct minor or obvious errors in your booking details at any time without liability to you.

  • 6.6.1 In the event of such cancellation due to unforeseen circumstances, unscheduled maintenance, or unsuitable or unexpected weather conditions, which may include:
  • Change in weather conditions such as:
    • Unclear sky viewing;
    • Heavy rain;
    • High winds;
    • Poor visibility;
    • Dangerous sea conditions;
    • Dangerous landing conditions.
  • Unforeseen circumstances such as:
    • Break down or engine trouble;
    • Passenger or crew member illness or injury;
    • Imminent danger to crew and/or passengers.
  • 6.6.2 We will notify you about these changes as soon as possible via the email address provided or call you directly on the number you provided when booking. We will always give you a reason as to why we have cancelled your AquaTerra Tour Arrangements.
  • 6.6.3 Should the AquaTerra Tour Arrangements not occur due to unscheduled maintenance or unsuitable weather; the client / Party Leader’s money will be fully refunded to the source through the booking and payment system.Please allow five (5) to ten (10) business working days to fully process this.
  • 6.6.4 If and when possible, we will try to offer you an alternative tour option / time / date to try and accommodate you; however, we will only operate the AquaTerra Tour Arrangements when it is safe to do so.
  • 6.6.5 If we do not operate and cancel your booking, we apologise for any inconvenience caused. However, your safety, our crew members', and guests / PAX's is of the utmost importance to us.
  • 6.6.6 On board our “Ultimate Skellig Coast Tour”, which operates outside of Valentia Harbour and around the Skellig Islands, where the tour has been attempted, tour information shared by the tour guide / crew and the Captain / Skipper has decided to reduce the tour due the points listed above in section 6.6.1, a partial refund may be made.
    • 6.6.6.1 In this case, a request for a partial refund of up to 50%, depending on the duration of the trip / tour and information received, may be made AquaTerra or the selling agent. This is subject to the amount of information delivered and time spent onboard.

7. Wildlife

7.1 Any wildlife-watching venture that includes whales, dolphins, seals or bird life can be unpredictable. Unfortunately, due to the inherent nature of viewing wild animals in their natural habitat, we cannot guarantee with 100% certainty that there will be sightings on every tour.

  • 7.1.1 Your crew and Skipper / Captain will do their best to ensure you see wildlife, but sometimes the weather or wildlife do not cooperate. We do not offer money-back guarantees in the possible event of no sightings during your tour.
  • 7.1.2 Please note that we strictly practice 'consideration and non-interference' when dealing with all wildlife. We do not chase and prefer to allow wildlife and sea life to approach us by switching off the engine when we get close to or cross their path. We do not feed or allow people to swim with animals, and we maintain a safe distance from wildlife and other boats whenever possible.
  • 7.1.3 This practice aligns with the principles of Páirc Mhara Chiarraí (Kerry’s Marine Park) and follows national and international marine conservation guidelines, including the Wildlife Act 1976, the EU Habitats Directive, and best practices recommended by the National Parks & Wildlife Service (NPWS). We also adhere to the Leave No Trace initiative principles to ensure that our operations have minimal impact on the environment. Guests are kindly asked to respect these guidelines and follow the crew’s instructions at all times to help protect Kerry’s unique marine ecosystem for future generations.

8. Behaviour

8.1 If, in our reasonable opinion, at any point during the AquaTerra Tour Arrangements related to your booking, you are behaving in a manner that is likely to cause danger, distress, annoyance to others, or damage to property, we may terminate your booking.

  • 8.1.1 In such an event, we, Kerry Aqua Terra Ltd., shall not be liable for any refunds, compensation, or reimbursement of any costs or expenses incurred as a result. You will be responsible for covering your travel back to your point of origin.
  • 8.1.2 Should we incur any expenses due to your behaviour, you shall fully compensate us (Kerry Aqua Terra Ltd) for those expenses.

8.2 We, Kerry Aqua Terra Ltd., reserve the right to deny boarding to any individual or passenger who is under the influence of alcohol or drugs, as well as to those who display behaviour that could endanger themselves, other passengers, or the crew.

  • 8.2.1 In such cases, we, Kerry Aqua Terra Ltd., shall not be liable for any refunds, compensation, or reimbursement of any costs or expenses incurred as a result. You will bear responsibility for your travel back to your point of origin.

9. Health & Safety

9.1 We, Kerry Aqua Terra Ltd., are a boat tour provider/operator and all of our KAT Tour Arrangements options are weather-dependent. This must be understood by the client / guest or third-party partaking with us that we will only operate when it is safe to do so and that the experience can be enjoyed by all.

9.2 Boat capacity for PAX and Crew:

  • 9.2.1 “The Navigator”, 12 PAX and 2 crew. The “Skellig Bounty”, 12 PAX and 2 crew.

9.3 Age Limitations on Tour / Trip / Private Charter or Private Group Adventures:

  • 9.3.1 In compliance with our safety procedures, we, Kerry Aqua Terra Ltd., do not accommodate children under the age of 2 on any of our tours.
  • 9.3.3.3 Additionally, the following age restrictions apply to specific tours:
  1. The “Valentia Island Experience”, is suitable for 3-year-olds and above.
  2. The “Ultimate Skellig Coast Tour”, is suitable for 10-year-olds and above.
  3. The “Wildlife Eco Cruise”, is suitable for 10-year-olds and above.
  4. The “Dingle Day Trip”, is suitable for 10-year-olds and above.
  5. The “Inishtearaght Lighthouse Secrets”, is suitable for 10-year-olds and above.
  6. The “Pirates & Whiskey Quest” is suitable for 14-year-olds and above.
  • 9.3.3.4 Tours on board “Skellig Bounty” venture out into open waters, and for safety reasons, this experience is only suitable for children aged 10 and over or those at least 130 cm in height.
  • The Child(s)’s feet must touch the floor / deck when seated as the “Ultimate Skellig Coast Tour” and “Wildlife Eco Cruise”, ventures out to sea / Dingle Bay.
  • 9.3.3.5 The “Pirates & Whiskey Quest” is suitable for 14-year-olds and above. This is due to its historical content and adult humour.
  • Guests partaking in enjoying an alcoholic beverage must be over the age of 18 years to legally drink alcohol in Ireland. The AquaTerra crew may request ID. (Please be drink aware or find out more at www.drinkaware.ie).
  • 9.3.2 As of Summer 2025, we will have a small kiosk / hut located on the seafront in Knightstown village, Valentia Island. We will be able to measure the Child onsite should you still wish to partake in the tours referenced above (point 9.3.1.).

9.4 It is your responsibility to ensure that you are physically fit and healthy to travel and participate in all parts of the AquaTerra Boat Tour Arrangements that you have booked and undertaken as described in our company’s brochure or tour description.

9.5 Should you need to take any medication with you, it is your responsibility to ensure you have the required medication with you. If you have any medical conditions or feel unwell during the KAT Tour Arrangements, it is your responsibility to inform the crew/Skipper when getting on or throughout the duration of the time onboard our boats.

9.6 Embarking on any of the Tour Arrangements that Kerry Aqua Terra Ltd. (referred to as AquaTerra Boat Tours) operate, demands the utmost responsibility from our guests / PAX. It is your responsibility to consider the following guidelines before joining.

  • 9.6.1 If guests are susceptible to seasickness, it is your responsibility to exercise caution before deciding to participate, due to the unpredictable nature of the sea that may trigger / lead to discomfort.
  • 9.6.2 It is the responsibility of those individuals with pre-existing back / body issues to assess their ability to withstand unpredictable sea conditions, as their safety and well-being are paramount.
  • 9.6.3 It is the responsibility of any pregnant individual to prioritise their safety and refrain from joining any AquaTerra Boat Tour Arrangement.
    • 9.6.3.1 Heavily pregnant individuals are urged to withdraw from any AquaTerra Boat Tour Arrangements with every precaution taken to ensure a safe experience for all.
  • 9.6.4 It is the responsibility of any guest/s / PAX with an intense fear of water to avoid all AquaTerra Boat Tour Arrangements as it may be too overwhelming.
  • 9.6.5 The safety of all guests / PAX is the top priority for any AquaTerra Tour Arrangement, as we aim for a memorable experience.
    • 9.6.5.1 If there are any doubts about suitability for any Tour / Trip / Private Charter or Private Group Adventure provided by Kerry Aqua Terra Ltd. (referred to as AquaTerra Boat Tours), guests are encouraged to consult with a medical professional before booking.

9.7 It is your responsibility to wait safely at public locations (any pontoon, marina, pier, beach / island) where pick up / drops are conducted for any AquaTerra Boat Tour Arrangements.

9.8 It is your responsibility to listen to and follow all safety information, directions and advice given to you by the designated crew / Skipper onboard. You will be issued a seat and it is your responsibility to remain in the seat unless otherwise directed by the crew/Skipper.

9.9 If issued with a lifejacket, it is your responsibility to follow the donning instructions and wear the life jacket correctly when onboard the Tour / Trip / Private Charter or Private Group Charter Adventures.

9.10 For any Tour / Trip / Private Charter or Private Group Charter Adventures arranged with a food / beverage or prosecco picnic option, it is your responsibility to inform us at the time of booking or no later than 4 days before departure of any food / beverage allergies, intolerances or dislikes.

9.11 We, Kerry Aqua Terra Ltd., outsource the food / beverages with a local supplier / local hotel, and must have all food / beverage orders booked 5 days in advance. Food / beverages or prosecco picnic are subject to availability and may vary slightly from booking to booking. Persons must be 18 years of age or older to enjoy our alcohol options.

Guests partaking in enjoying an alcoholic beverage must be over the age of 18 years to legally drink alcohol in Ireland. The AquaTerra crew may request ID. (Please be drink aware or find out more at www.drinkaware.ie).

9.12 As of Spring 2021, we, Kerry Aqua Terra Ltd., have not and will not assist or take campers onto or off Beginish Island or Church Island, as there are no facilities on the islands.

  • 9.12.1 It is you responsibility when visiting Church Island and Beginish Island to be respectful and be aware of your surroundings, including:
    1. Heritage sites-e.g., 8th Century Monastic Site and Viking Settlement;
    2. Uneven surfaces;
    3. Steep rock areas;
    4. High/low cliff edges;
    5. Unmanned beach;
    6. Wildlife such as birds, seals and sheep;
    7. Privately owned houses and land areas on Beginish Island.
  • 9.12.2 For those who avail of the Water Taxi / Ferry to Church Island or Beginish Island, this service will be available daily during the summer season. However, similar to our other AquaTerra Tour Arrangements options, the Water Taxi / Ferry to Church Island or Beginish Island is weather permitting and will only operate when it is safe to do so.
  • 9.12.3 It is your responsibility when visiting Church Island and / or Beginish Island to take all rubbish and items that you took over – take away with you so as to reduce litter and retain the beauty of the Islands.

9.13 Family dogs will only be allowed on board if we, Kerry Aqua Terra Ltd., have been notified in advance of the tour Arrangements.

  • 9.13.1 As of Spring 2024, dogs will only be allowed on privately booked AquaTerra Boat Tour Arrangements.
  • 9.13.2 Unfortunately, Dogs are no longer permitted on any tours due to safety concerns related to boat movement, water conditions and the safety of the crew and other passengers onboard.

10. Limitation of Liability

10.1 We take reasonable care to ensure the accuracy of the information in our brochures, leaflets, social media channels and our website. However, content is subject to change, often due to the actions of our suppliers (e.g., hotels, activity providers, third-party platforms etc.), inflation and the running costs of the business.

We will endeavour to notify you of any change known to us that may affect your tour prior to issuing you your booking confirmation and, subsequent to this, as soon as our suppliers notify us of any changes.

10.2 The tours operated or supplied by us, Kerry Aqua Terra Ltd. (referred to as AquaTerra Boat Tours), have been designed to provide participants with exposure to the true nature of the environment visited and, therefore, involve an element of risk and exposure to potential hazards over and above those associated with normal “package” tours.

  • 10.2.1 All AquaTerra Tour Arrangements bookings are accepted on the understanding that you appreciate such risks and hazards and that you are undertaking all AquaTerra Tour Arrangements of your own volition. The specific itinerary, inclusions, and additional information related to group tours are detailed in the tour-specific trip notes.
  • 10.2.2 We, Kerry Aqua Terra Ltd., are not liable to pay you compensation nor be held responsible for booked air, sea, rail, or road transport or any accommodation due to KAT Tour Arrangements being cancelled or rescheduled, as this action has been completed in compliance with our stringent safety procedures.
  • 10.2.3 We must remind you that we, AquaTerra Boat Tour, are a boat tour provider / operator, and we, as the company, are totally weather-dependent when operating. The circumstances for cancellation or rescheduling of the AquaTerra Tour Arrangements may include, but are not limited to:
    • Unforeseeable circumstances;
    • Unsafe conditions onboard;
    • Adverse weather or unexpected weather conditions may include:
      • Unclear sky viewing;
      • Heavy rain;
      • High winds;
      • Poor visibility;
      • Dangerous sea conditions;
      • Dangerous landing conditions.
    • Technical problems or unscheduled maintenance to the boat(s);
    • Fire or flood;
    • Actions of national or local governments.
  • 10.2.4 We do not accept liability where any failure to provide any services in accordance with the contract or any other form of loss or damage is due to your own fault or that of any party named on your booking, including any failure to comply with your obligations in this contract, or is the result of our compliance with any instruction, request or direction given by you.
  • 10.2.5 We, Kerry Aqua Terra Ltd., are not liable to pay you compensation nor be held responsible for persons that slip / trip / fall when waiting or that have been dropped off at any of the agreed public locations (any pontoon, any marina, any pier, beach or island) that we the company operate at/from.
  • 10.2.6 We, Kerry Aqua Terra Ltd., are not liable to pay you compensation nor be held responsible for persons that slip / trip / fall or any injury or illness when visiting or availing of the Water Taxi / Ferry to Church Island or Beginish Island separately or during any part of any KAT Tour Arrangements.
  • 10.2.7 We are not responsible for the content, policies and services of any sites linked to or accessible via the Kerry Aqua Terra Ltd. website.

11. Changes to Policy

11.1 Kerry Aqua Terra Ltd. (referred to as AquaTerra Boat Tours), reserves the right to update and / or alter these terms and conditions at any time. It is your responsibility to be familiar with these terms and conditions.

11.2 These terms and conditions were most recently changed / updated February 2025.

11.3 All tour bookings are bound by the terms and conditions in effect at the time of the booking.

12. Complaints

12.1 If a guest / client has a complaint about any of the AquaTerra Tour Arrangements, you must bring it to the attention of the tour leader, crew member or other representative of the Company at the time so that they may use their reasonable endeavours to rectify the situation as soon as possible.

12.2 Failure to complain at the time will affect your ability to claim compensation from the Company. Should the problem remain unsolved, a complaint must be made in writing to the Company within a reasonable time period of not more than thirty (30) days after the completion of the tour.

13. Disclaimer

13.1 While Kerry Aqua Terra Ltd. makes every effort to provide on-time service, it does not guarantee its departure and arrival times, which may be delayed due to any number of factors, including weather, traffic or road conditions, mechanical problems, or any other causes or conditions beyond AquaTerra’s control. Kerry Aqua Terra Ltd. reserves the right to cancel or change any tour, advertised schedule or route, without notice.

13.2 Kerry Aqua Terra Ltd. assumes no liability or responsibility for injury, loss, or damage to persons or property, inconvenience, delay, or expense arising from or caused by weather conditions, acts of God, war, accident, government restrictions or regulations, from an act or omission of any individual, traffic or road conditions, mechanical problems or any other causes or conditions beyond Kerry Aqua Terra Ltd.’s control. Fares are subject to change without notice. Kerry Aqua Terra Ltd. is not liable for lost, stolen or destroyed tickets. Tickets are non-refundable.

13.3 Kerry Aqua Terra Ltd. reserves the right, without refund of any portion of the ticket purchase price, to refuse admission to or eject any person whose conduct is disorderly, who uses vulgar or abusive language, or who fails to comply with the rules, terms and conditions applicable to guests on the tour. If you witness disorderly conduct or suspect a problem with a fellow passenger, please immediately notify your Kerry AquaTerra tour guide.

13.4 By presenting a valid Kerry AquaTerra ticket or a ticket issued by a certified agent on our behalf for admission, you hereby consent to Kerry Aqua Terra Ltd.’s use of your voice, image or likeness incidental to any video and/or audio-recorded program or photograph of the tour for any and all purposes without compensation to you. Any person under the age of 13 must be accompanied by a person at least 18 years of age or older at all times.

13.5 The use or consumption of alcoholic products is strictly prohibited on our tours unless agreed prior to the Tour / Trip / Private Charter or Private Group Adventure. Irish law prohibits smoking in any public buildings or places of work, including vehicles.

13.6 Video and audio recordings of our tour guides or audio guides headsets / units on any Tour / Trip / Private Charter or Private Group Adventure are strictly prohibited.

To fulfill this, we aim to adhere as strictly as possible to the World Wide Web Consortium’s (W3C) Web Content Accessibility Guidelines 2.1 (WCAG 2.1) at the AA level. Our website implements the ARIA attributes (Accessible Rich Internet Applications) technique, alongside various different behavioral changes, to ensure blind users visiting with screen-readers are able to read, comprehend, and enjoy the website’s functions. As soon as a user with a screen-reader enters your site, they immediately receive a prompt to enter the Screen-Reader Profile so they can browse and operate your site effectively. Here’s how our website covers some of the most important screen-reader requirements, alongside console screenshots of code examples:

  1. Screen-reader optimization: we run a background process that learns the website’s components from top to bottom, to ensure ongoing compliance even when updating the website. In this process, we provide screen-readers with meaningful data using the ARIA set of attributes.     These adjustments are compatible with all popular screen readers, including JAWS and NVDA.

  2. Keyboard navigation optimization: The background process also adjusts the website’s HTML, and adds various behaviors using JavaScript code to make the website operable by the keyboard. This includes the ability to navigate the website using the Tab and Shift+Tab keys, operate dropdowns with the arrow keys, close them with Esc, trigger buttons and links using the Enter key, navigate between radio and checkbox elements using the arrow keys, and fill them in with the Spacebar or Enter key.Additionally, keyboard users will find quick-navigation and content-skip menus, available at any time by clicking Alt+1, or as the first elements of the site while navigating with the keyboard. The background process also handles triggered popups by moving the keyboard focus towards them as soon as they appear, and not allow the focus drift outside it.

    Users can also use shortcuts such as “M” (menus), “H” (headings), “F” (forms), “B” (buttons), and “G” (graphics) to jump to specific elements.

  2. Color adjustments – users can select various color contrast profiles such as light, dark, inverted, and monochrome. Additionally, users can swap color schemes of titles, texts, and backgrounds, with over seven different coloring options.
  3. Animations – person with epilepsy can stop all running animations with the click of a button. Animations controlled by the interface include videos, GIFs, and CSS flashing transitions.
  4. Content highlighting – users can choose to emphasize important elements such as links and titles. They can also choose to highlight focused or hovered elements only.
  5. Audio muting – users with hearing devices may experience headaches or other issues due to automatic audio playing. This option lets users mute the entire website instantly.
  6. Cognitive disorders – we utilize a search engine that is linked to Wikipedia and Wiktionary, allowing people with cognitive disorders to decipher meanings of phrases, initials, slang, and others.
  7. Additional functions – we provide users the option to change cursor color and size, use a printing mode, enable a virtual keyboard, and many other functions.

Browser and assistive technology compatibility

We aim to support the widest array of browsers and assistive technologies as possible, so our users can choose the best fitting tools for them, with as few limitations as possible. Therefore, we have worked very hard to be able to support all major systems that comprise over 95% of the user market share including Google Chrome, Mozilla Firefox, Apple Safari, Opera and Microsoft Edge, JAWS and NVDA (screen readers).
